The DOL published a final rule on August 29th implementing the Executive Order on " Non -Displacement of Qualified Workers" under SCA contracts. Earlier, on August 10th, the Office of Federal Contract Compliance Programs published an advance notice of proposed rulemaking in the Federal Register on a new Compensation Data Collection Tool. OFCCP is increasing its audit and investigative activity, and this would be another tool to root out non-compliance with Equal Employment Opportunity and anti- discrimination requirements. While a proposed rule is likely in the next several months, a number of questions regarding the scope and details of the data collection tool and related items must be addressed.

The U.S. Dept. of Labor has issued an ALL AGENCY MEMORANDUM NUMBER 210 dated June 10, 2011 changing the current Service Contract Act (SCA) Health and Welfare Fringe Benefit. In accordance with 29 C.F.R. Section 4.52, the prevailing health and welfare fringe benefits issued under the McNamara-O’Hara Service Contract Act will be increased on June 17, 2011. Effective June 17, 2011, the new SCA health and welfare benefit will be $ 3.59 per hour and will be posted on the Wage Determination Online and Wage and Hour Division websites.

The History in this memo is the same as previous years and the fringe benefits rates for Hawaii will be raised to $ 1.47 per hour other than employees not receiving mandated health care benefits which will receive the new health and welfare amount of $ 3.59 per hour.

The grandfathered average cost fringe benefit determinations for Hawaii currently provide for payments costing an average on $ 1.64 per hour. Since this rate is still above the new $ 1.47 per hour rate for Hawaii, the current $ 1.64 average cost fringe benefit level for Hawaii willcontinue to be grandfathered.

See the Memo for all the other details, and we recommend that contractors do not pay the new rates until their respective contracting agencies modify your contracts with the revised rates.
